Cyclists and TAC after 8 July 2014

Harry Gill | | Injury Law, Motor Vehicle Accidents

Anna Vadaketh of Robinson Gill reported in a blog on 7 June 2018 about a proposed amendment to the Transport Accident Act (TAA), which governs TAC claims. We are pleased to advise that this has now come into effect.

Many cyclists are not covered by TAC because the TAA basically extends coverage to motor vehicles, trains and trams.  There have always been some exceptions.  The good news is that there is now a specific exception for the fairly common situation where a cyclist collides with a stationary vehicle.

Importantly, this is retrospective for anyone in such a collision on or after 9 July 2014.

If a cyclist has had his/her claim rejected by the TAC, they should obtain legal advice immediately because there may be time limits within which such a claim can now be brought.
